Inspector rejects developer’s appeal to build in Kings Sutton

Rectory Homes wasn’t happy with West Northamptonshire Council’s decision against their application

A developer has lost their appeal against a decision not to allow them to build up to 32 houses on a greenfield site in Kings Sutton.   West Northamptonshire Council rejected the application by Rectory Homes in August last year.

They wanted to develop the site off Hampton Drive on the Little Rushes estate, to the north of Blenheim Rise.

After their application was refused, in March Rectory Homes appealed to the Planning Inspectorate.   The Inspector, Anne Jordan, gathered evidence which was considered at a hearing on July 26.   She made a visit to the site the following day.

Rectory Homes argued that Kings Sutton was a “Primary Village” in Northamptonshire and therefore one of the places most suitable for new housing, but the Inspector noted the proposal was outside the current settlement boundary, which was contrary to local planning rules.

Ms Jordan also noted that the Council had enough new housing lined up to meet its quotas, but did warn this wasn’t always a reason for refusing an application.   She said: “The development plan is up-to-date and these policies carry full weight.  I recognise that the five-year supply figure is not a cap to development. 

“Nevertheless, in the context of a 6.9 year supply of housing land, I am not persuaded that in this case the collective benefits of the scheme justify determining the proposal otherwise than in accordance with the development plan taken as a whole.”

Monday’s decision by the Inspector concluded that the appeal should be dismissed.
