Brackley bar and restaurant’s application to extend licensed hours granted

The Green Room can now play music and sell alcohol for longer hours once planning issues are resolved

An application which received three objections for a bar and restaurant in Brackley to extend its licensed hours has been granted.
TGR Bar and Restaurant Ltd, The Green Room, in Bridge Street applied to West Northamptonshire Council for a variation to its premises licence.
The council’s licensing sub-committee held a virtual hearing on July 7.
The owner of The Unicorn Hotel, Joao Silva, which is located next door to The Green Room, spoke at the hearing raising concern about the potential for noise.
The general manager of the Unicorn Hotel, Shaun Melson, who lives close to The Green Room, also spoke to object due to concern about noise disturbance at night time.
Nicholas Sutcliffe, the council’s licensing and business support manager, told the hearing: “There have been no complaints received from The Unicorn in relation to The Green Room during the entirety of the Green Rooms’s opening over the last eight years.
“In fact, we only have two complaints from the same member of the public over the last five years in relation to The Green Room.
“We have had no complaints from people using The Unicorn from what goes on at The Green Room either.”
Following the hearing, the premises was granted the following variation:
Sale of alcohol on the premises: Monday – Thursday 10.00 – 00.00, Friday – Saturday 10.00 – 02.00 and Sunday 10.00 – 23.00
Recorded music indoors: Monday – Thursday 10.00 – 01.00, Friday – Saturday 10.00-02.00 and Sunday 10.00 – 23.00
Late night refreshment: Monday – Thursday 10.00 – 00.00, Friday – Saturday 10.00 – 01.00 and Sunday 10.00 – 23.00
The sub-committee’s notice of decision reads: ‘Objections – The sub-committee received three objections to the application and considered all of the written representations ahead of the hearing and the issues raised.
‘Mr Silva and Mr Melson attended the hearing to make their representations in person.
‘Both objectors reiterated the points raised in their written representations contained within the report.
‘Application.- Mr Benson (general manager of The Green Room) made representations including providing the background of the property and the business in support of the application.
‘All promotions finish at 18.00. Explained most of the patrons are from the local community.
‘Mr Benson also explained specific locality considerations including use of bottle bins not to be used after 22.00 and windows shut when outside area closed.
‘After 23.00, only ‘soft’ music. Predominantly a restaurant selling high-end cocktails and wines. Mr Benson also addressed the comments made by the objectors.’
The notice states further on: ‘The applicant is reminded that they cannot benefit from the extended hours until the planning issues are resolved.’
In the report to the sub-committee, it stated that planning supplied a late response to consultation advising of planning restrictions.
It read: ‘Further to your notification we have to inform you that planning permission will be required for a new premises license.
‘The planning application S/2016/0373/FUL has the following condition imposed regarding opening hours.
‘In order to increase the opening hours on the premises you would need to apply for planning permission.
‘Please see the attached planning permission, which has the following condition imposed upon it:
‘The use hereby permitted shall be open to customers shall be restricted to the following times:- Monday – Wednesday : 8.30 a.m. to 5.00 p.m, Thursdays – Saturdays : 8.30 a.m. to 11:30 p.m. Sundays, Bank and Public Holidays : 9:00am to 3:00pm.’
