One of the three sites was rejected in July, but two given the go-ahead

A solicitor’s letter assets the Planning Committee had been materially misled

Members of Cherwell District Council’s Planning Committee may feel déjà vu next week when they consider four planning applications for logistics warehousing close to junction 10 of the M40.   That’s because they have already discussed and decided the applications during a marathon five-and-a-half hour planning meeting last July.

However, they must now reconsider the applications due to “several material changes in circumstances”.

The land in question is on both sides of the A43 between the Baynard’s Green roundabout and junction 10.

Planning records show that solicitors on behalf of Stoke Lyne Parish Council and the Tusmore Park Estate wrote to the council in August   They asserted that: “the Planning Committee had been materially misled in multiple important respects” and “the policy position has changed since the original Committee meeting”.   The letter went on to provide supporting evidence.

Back in July, despite their unease with the proposed developments, councillors took officers advice and conceded there were no defendable planning reasons to refuse applications for two of the sites.   The DID reject a third based on the visual harm to the area.

The latest officer’s reports for next week’s meeting is recommending acceptance of all of the applications this time.

The Committee will meet on Thursday afternoon at 4pm.
