Equipment was seized following complaints, but new items acquired

A King’s Sutton man has been fined after he repeatedly played loud music, leading to complaints from people nearby.

Oliver Page, who lives in Cherwell Banks, has been ordered to pay £5,800 following an appearance at Wellingborough Magistrates’ Court on January 27.

West Northamptonshire Council first received complaints about excessive and intrusive loud music from Page’s property during January last year.   Initially officers sought to resolve the issue by the issuing a Community Protection Warning.

However, the unreasonable noise continued so a Noise Abatement Notice was served.  Despite this, further disturbances were reported.

In July the Council obtained and executed a warrant at the property.   Several televisions and two speaker systems were seized in an attempt to prevent further disturbance to neighbours.   But new equipment was acquired within 48 hours, and further breaches of the Noise Abatement Notice occurred.

Over the following months the council gathered evidence demonstrating repeated non-compliance with the requirements of the Notice.

Page was found guilty of 40 offences relating to those breaches and fined £2,000, ordered to pay £3,000 in costs and an £800 victim surcharge, totalling £5,800.

Councillor Andrew Last is the council’s Cabinet Member for HR, Corporate, and Regulatory Services.   He said: “We understand how distressing persistent noise can be for residents and we always aim to resolve issues using a graduated approach in line with our enforcement policy.

“In this case, warnings and the formal notice were repeatedly breached, leaving the Council with no option but to pursue prosecution.   Everyone has the right to enjoy their home without unreasonable disturbance, and we will take action where nuisance continues.”
